Whoa!

11:37 PM. Anyone else seeing this? There’s what looks like a con trail overhead, but must be a searchlight because it’s moving north and south, shining west to east. I can’t get a picture of it on my IPhone 3 (not in this light) but it is NOT from the horizon – much higher.

  1. Just arrived home from Town Hall ZBA. Sky clear – beautiful full moon, signaling the start of the Jewish agricultural festival of booths. Too bad about the passing storm. Big tree down on Milbank. 0.31 inches of rain in 15 minutes at the Comly Ave rain and river gage station.

    Big night at ZBA.

    High School passed 5-0

    FAR upheld 5-0 even if the prior owner and ZEO fake it to over-build, tear it down you must, once you discover it as a new owner. No mercy here. And look at the due diligence issues raised. You cannot rely on Town records and prior CO’s or finding of ZEO. Check you must with your own surveyor and architect.

    Continuation of non-conforming use: Town code says 1-year of discontinuity is abandonment of use.
    State Code and case law say intent to abandon use must be shown. ZBA voted 3-1-1 (a failure to gain 4 necessary votes) t0 overturn ZEO sticking with State law and case law.

    To explain:
    ZEO = zoning enforcement officer
    ZBA = zoning board of appeals, designed to allow community mercy and hardships to over-rule zoning regs.
    regs = regulation
    FAR= Floor Area Ratio
    CO = certificate of occupancy
    “Due diligence” = the obligation of a purchaser to accept responsibilty and consequences of the acts of the prior owner.

    I wish we all celebrated the Festival Of Booths…it’s really a fun observance. In fact the whole ‘New Year” time from Yom Kippur to Rosh Hashana is excellent.

    Haven’t seen it yet but has anyone seen the “cardio-tennis” guy yet playing tennis in various rotaries about town?

    We see the Cardio Tennis dude at the Lake Avenue circle just about every week. Pretty effective out-of-home advertising, in my opinion. Capability to establish and reinforce brand awareness, curiosity to learn more, etc. appears superior to many other “media” the outfit could tap. And, probably quite cost effective relative to the target audience impressions this approach generates.

    The Cardio Tennis Guy started working back in the hottest days of July, swinging that racquet at the Lake Avenue Circle. He’s also been spotted working at the train station, and the other day he was on the Post Road. Will he become a Greenwich fixture, like the Naked Cowboy of Times Square?
